Please outline key points in prosecution and defence cases.
|
9/10/2019 Whitehall. Glued on to another person and right hand in a tube with one other. PC said he gave her 20 – 30 seconds to consider her response after warning being issued. She was not interviewed after arrest. BWV shown where officer said offence was breach of Section 14. Defence: police had cordoned off the road, the removal of Defendant would not have cleared the road. Defendant: on arrival at the protest she had tried to get to Trafalgar Square but all roads towards there were blocked and people attempting to get to Trafalgar Square (the designated area of lawful protest) were being turned back by the police. She therefore went to Whitehall as she wanted to get as close to Downing St as possible. Had been on the site 1 hour prior to arrest. As she was glued on to the person next to her, moving was not an option. She did not object to moving once unglued. Roads had been closed off by the police before she arrived. |
