  1. Was the Section 14 order lawful

CPS: the days of the Rebellion had different names and focus therefore it did not constitute a continuous protest.

Defence: there was one continuous Rebellion with a series of protest events. AC Ralph was not the senior officer on site on 2nd September and therefore it was not lawful for her to extend the S14 notice.

DDJ Price ruled that the events were separate and therefore S14 notice was lawful

 

  1. The defendant was informed of the S14 notice by the arresting officer who asked him to leave the road and protest on Parliament Sq Gardens. The officer warned him that he would be arrested if he was still protesting in the road in 30 seconds. RGT stayed on the road and was arrested
