Defendant had just joined the samba band on Gt George St when he was approached by the arresting officer. He was arrested within 50 secs (timed on the bwv). The judge said there is no time limit for arrests, he could have been arrested immediately.

Although he had said, “I can’t hear you”, he didn’t stop drumming, and walked away.

He tried necessity with predictable results.

Another person was arrested in the same place and time but was never charged. Why was his case different? When he returned from Custody, he saw the band still playing there but no arrests wewre being made. Why? The judge said that each case was judged on its merits, separately.
